This California Privacy Statement (“Statement”) applies to “consumers” as defined by the California Consumer Privacy Act (“CCPA”) and supplements the Shenzhen Xiaohaijing Culture Co., Privacy Policy or Statement. If any other company policy, statement or notice conflicts with this Statement, this Statement will control with respect to California consumers and their rights under the CCPA . Please also refer to any privacy policy or generally applicable statement posted or referenced on our website, products or services, including but not limited to: https://www.bezzze.com/policies/privacy-policy.

 

This Statement covers the collection, use, disclosure and sale of “personal information” (“PI”) of California consumers as defined by the CCPA, unless such PI is exempt from the CCPA’s notice obligations. This Statement also covers the rights that California consumers have under the CCPA and other notices required by other laws to be given to California residents. As required by the CCPA, the description of our data practices in this Statement covers the previous 12 months and will be updated annually. However, if there is a material difference such that we believe consumers would reasonably expect to be notified, our practices may change next year and we will provide notice of the applicable collection, which may include references to other applicable privacy policies and notices.


Under the CCPA, job applicants, current and former employees and independent contractors (“Personnel”), and persons acting solely on behalf of another business for certain business-to-business communications, are not “Consumers” for purposes of this California Privacy Statement or the rights described herein. However, our Personnel may obtain a separate privacy notice that applies to them by contacting their Human Resources department. Publicly available information is also not considered Personal Information (PI) under the CCPA, and therefore, this Statement does not apply to that data, and your consumer privacy rights do not apply to that data.

 

For ease of reading, we have abbreviated or summarized the CCPA terms or language in some places and have cited specific provisions of the CCPA in some places in this Statement for your reference. Terms defined in the CCPA used in this Statement shall have the same meanings as in the CCPA.

 

    1. Personal Information We Collect


    We collect, maintain, use, and disclose PI about California consumers, including information from the past 12 months, as follows:

Internet Usage Information This may include, but is not limited to: browsing history, search history, and information about your interactions with internet websites, applications, or advertisements.     As permitted by applicable law, we do not treat de-identified data or aggregated consumer information as PI, and we reserve the right to convert your Personal Information to de-identified data or aggregated consumer information, or to permit others to convert your Personal Information to de-identified data or aggregated consumer information. We have no obligation to re-identify such information or to retain it for longer than necessary for us to respond to your request. This helps us practice data minimization, which we believe is a privacy best practice and consistent with our mission to respect our customers.

     

    A. PI Sources


    We may collect your personal information directly from you or from service providers, suppliers, our affiliates or other individuals and businesses. Please see the table above for more details on each type of personal information.


    B. Use of Personal Information


    In general, we collect, retain, use and disclose your personal information to provide you with services and for other purposes related to our business operations. For specific details on the personal information we collect and the purposes for which we use it, please refer to the table above, “ Personal Information We Collect” . For more details on our disclosure of personal information, please refer to the next section, “Sharing of Personal Information”. 


    As described in more detail in the table above, we may collect, use, and disclose the PI we collect for one or more of the following business purposes:

     

    • Processing Interactions and Transactions;
    • Managing Interactions and Transactions;
    • Performing Services;
    • Research and Development;
    • Quality Assurance;
    • Security;
    • Debugging.

     

    Our vendors may also use your PI for some or all of the Business Purposes listed above, subject to the restrictions and obligations under the CCPA.


    In addition, we may collect, use and disclose your personal information for other operational business purposes, as detailed in the table above. Our suppliers may engage their service providers or subcontractors to enable them to perform services for us. For clarity, such subcontracted processing falls under the additional business purpose that we notify you of.


    In addition, we may collect, use and disclose your PI as required or permitted by applicable law.

     

    Financial Incentives. Participation in financial incentive programs administered by us or our partners may entitle you to special offers and benefits. To administer such programs, we may need to sell, collect, disclose, or retain your personal information. Members of financial incentive programs may receive incentives, such as gift cards, products, and other rewards, at their discretion. For more details on available programs, including incentives, please refer to the registration page for the applicable financial incentive program. We may use any categories of personal information we collect to administer and determine the size of our financial incentives. We calculate the value of your data based on the increase in spending resulting from administering the financial incentive programs. You may opt out of participating in financial incentive programs at any time by sending an email toinfo@bezzze.com. For more information on how we will use your PI under these programs, please refer to our Notice of Financial Incentives for California Customers.

     

    C. Retention


    Our records, including all categories of personal information we collect, are retained in accordance with regulatory, legal and business requirements and obligations. We retain all documents, including personal information, that are relevant to any actual or reasonably anticipated claim, litigation, investigation, subpoena or other governmental proceeding.

    We also share personal information at the consumer's direction, such as with banking partners (for financing) and our retailers. Any disclosures to outside auditors are strictly used to ensure that we meet our obligations with respect to insurance and government reimbursement programs.


    By using the Services, you accept and consent to our collection of such data and sharing of that data with our service providers.


    B. Sale of PI:


    Under the CCPA, our “selling” or “sharing” is limited to our use of third-party cookies or similar technologies for advertising and/or analytics purposes.
    We may “sell” or “share” PI in the following ways:

    We also transfer personal information to banking partners and our retailers, but this is done at the direction of the consumer and does not constitute a sale. We also disclose personal information to government entities, such as for reporting purposes, but this also does not constitute a sale of personal information.

     

    3. California Privacy Rights


    We offer California consumers the privacy rights described in this section. You have the right to exercise these rights through an authorized agent who meets the requirements of the CCPA and related regulatory authorities. Under the CCPA, any request you or your agent submits to us is subject to an identity verification process ("verifiable consumer request "). We will not fulfill your CCPA request unless you provide sufficient information for us to reasonably verify that you are the consumer about whom we collected personal information and, if applicable, that your agent is authorized to act on your behalf. Please follow the instructions on our Consumer Rights Request page and respond to any follow-up inquiries we may have. You can also obtain information about how to make and submit a request by speaking with a manager at any of our company retail stores. Please note, however, that our products may be sold at independent retailers that we do not own or control, and these retail stores do not participate in our privacy program on our behalf. However, they may have their own privacy programs that are relevant to their data practices (not ours).

     

    Some of the PI we retain about consumers is not sufficiently associated with sufficient PI about the consumer so that we cannot verify that it is the specific consumer’s PI when a consumer makes a request that requires verification under the CCPA’s verification standards (e.g., clickstream data tied solely to a pseudonymous browser ID). As required by the CCPA, we will not include that PI in our responses to these requests. If we are unable to comply with a request, we will explain why in our response. You do not need to create an account with us to make a verifiable consumer request. We will only use the PI provided in a verifiable consumer request to verify your identity or authority to make the request and to track and record responses to the request, unless you also provide it to us for another purpose.

     

    We will make commercially reasonable efforts to identify the consumer PI we collect, process, store, disclose, and otherwise use and to respond to your California Consumer Privacy Rights request. In some cases, particularly for large amounts of and/or generally irrelevant data, we may suggest that you receive the most recent PI or a summary and give you the opportunity to choose whether you want the rest of the data. We reserve the right to direct you to where you can access and copy the responsive PI at your own discretion. We will not generally charge a fee to fully respond to your request; however, we may charge a reasonable fee or refuse to act on a request if your request is excessive, repetitive, unfounded, or overly burdensome. If we determine that the request warrants a fee or that we may deny it, we will notify you explaining our reasons for that decision. Before we charge you a fee for responding to your request, you will be provided with a cost estimate and the opportunity to accept such fee.


    In accordance with the CCPA and our concern for the security of your PI, we will not provide you with your Social Security number, driver’s license number or other government-issued identification number, financial account numbers, any medical identification, account passwords, or security questions or answers in response to a CCPA request.

    Your California Consumer Privacy Rights are as follows:

     

    A. The Right to Know:

     

    i. Information Rights

     

    You have the right to send us a request, no more than twice in a twelve-month period, for any of the following:

     

    • The categories of PI we have collected about you.
    • The categories of sources from which we collected your PI.
    • The business or commercial purposes for our collecting or selling your PI.
    • The categories of third parties to whom we have shared your PI.
    • The specific pieces of PI we have collected about you.
    • A list of the categories of PI disclosed for a business purpose in the prior 12 months, or that no disclosure occurred.
    • A list of the categories of PI sold about you in the prior 12 months, or that no sale occurred. If we sold your PI, we will explain:
         1. The categories of your PI we have sold.
         2. The categories of third parties to which we sold PI, by categories of PI sold for each third party.

In order to verify your request and look up your personal information in our database, we may ask you to provide your first name, last name, email address, and zip code. For your specific information, as required by the CCPA, we will apply the enhanced verification standard set forth in paragraph (ii) below.

     

    ii. Obtain a copy of PI

    You have the right to make or obtain a portable copy of your personal information that we have collected, but no more than twice within a twelve-month period. To make a request, please complete our online form by clicking on the "Consumer Rights Request" link in the footer of our website, or call +86 189 0303 5251. To verify your request and retrieve your personal information from our database, we will ask you to provide your first name, last name, email address, postal code, and proof of address.

     

    B. Prohibition on the sale of personal information

     

    You have the right to opt out of certain of our online tracking features, which may be considered “selling” or “sharing” under California law. You can opt out of “sharing” or “selling” by setting the “Global Privacy Controls” option at the browser level. We do not knowingly sell or share personal information of minors under the age of 16.

     

    C. Delete

    You may request that we delete PI that we collected directly from you and maintain, unless we have a basis for retention under the CCPA. We reserve the right to do so to fulfill transactions and services you have requested or reasonably anticipated, for security purposes, for legitimate internal business purposes (including maintaining business records), to comply with laws, to exercise or defend legal claims, and to cooperate with law enforcement. Please also note that we have no obligation to delete PI that we did not collect directly from you. To make a request, please complete our online form, click on the “Consumer Rights Request” link in the footer of our website or call +86 189 0303 5251. In order to verify your request and remove your personal information from our database, we will ask you to provide your first name, last name, email address, and zip code.


    However, you may also choose to exercise more limited control over your PI, such as unsubscribing from our marketing emails by accessing the last email and clicking “unsubscribe” at the bottom of the email.

     

    D.Correct


    You can ask us to correct personal information that you believe is incorrect. Subject to other exceptions, we may not change personal information if we believe the information is more likely than not to be accurate. To make a correction request, please fill out our online form or call +86 189 0303 5251. In order to verify your request and correct your personal information from our database, we will ask you to provide your first name, last name, email address, and postal code.


    E. Non-discrimination


    We will not discriminate against you in a manner prohibited by the CCPA because you exercise your CCPA rights.


    F. Authorized Agents


    Consumers may designate an authorized agent to make a request on their behalf under the CCPA. If a consumer chooses to submit a request through an authorized agent, we ask that the consumer:

     

    • Provide the authorized agent with written permission to submit the request, and provide us with a copy;
    • Verify the instruction and their own identity directly with us (unless the agent has verified the power of attorney).

     

    If the authorized agent holds a power of attorney issued pursuant to California Probate Code Sections 4000 to 4465, no written agreement is required. We will reject any application submitted through an agent if both of the above general conditions are not met. In addition, agents are subject to the verification standards applicable to the type of application being submitted.

     

    G. Sensitive Personal Information


    The CCPA gives you the right to direct businesses to limit their use or disclosure of your sensitive personal information (such as race or precise geographic location) to only what is necessary to perform the service or good you reasonably expected when you requested it and to perform certain activities permitted by the CCPA. Please note that we do not use sensitive personal information for any purpose other than necessary to provide the relevant service or permitted by the CCPA, so you do not have the right to opt out.


    H. Limitation of Rights:


    Notwithstanding anything to the contrary, we may collect, use, and disclose your personal information as required or permitted by applicable law, and this may override your CCPA rights. In addition, we are not required to implement any of your requests if it violates our rights or the rights of any other person or group or conflicts with applicable law.

    4. California Additional Notice


    In addition to CCPA rights, some California residents have certain additional notice rights, including:


    A. Third-Party Marketing and Your California Privacy Rights


    California’s “Shine the Light” law permits California residents to request certain information from us regarding our disclosure of PI to third parties for their own direct marketing purposes.

    We do not share personal information as defined in California Civil Code § 1798.83 (the “Shine the Light Law”) with third parties for their direct marketing purposes without your consent (for example, when you direct us to send your PI to a retailer) or your right to opt out. To opt out of sharing with third parties for their direct marketing purposes, please check here. If you are a California resident, you may request information about our compliance with the Shine the Light Law by writing to Room 1320, Building 10, Lehui Science and Technology Innovation Center, No. 489, Jihua Road, Bantian Community, Bantian Street, Longgang District, Shenzhen (Attn: Legal Department - Data Privacy) or emailing info@bezzze.com. Any such request must include “California Privacy Rights Request” in the first line of the description and include your name, street address, city, state, and zip code. Please note that we are only required to respond to one request per customer per year, and we are not required to respond to requests made by methods other than this email address or mailing address.

     

    Because these rights are different from your CCPA rights and exist under different laws, you must exercise your rights under each law separately.

     

    B. Online Privacy Practices

     

    For more information about our online practices and your rights in California with respect to our online services, please see our Online Privacy Policy. Including but not limited to the following: California residents who access our online services to seek or obtain goods, services, funds or credit for personal, family or household purposes are entitled to the following notice of rights:

     

     

    • Tracking and positioning

     

    When you visit our online services, we and third parties may use tracking technologies to collect usage information based on your device for a variety of purposes, including to serve you advertising based on your visits to our services or your activities over time and across third-party locations. Some browsers may allow you to turn on or off so-called “Do Not Track” signals. Because there is not yet a consensus in the industry on what these signals mean and how they work, we do not receive or respond to “Do Not Track” signals. For more information on tracking and targeting, and your choices regarding these practices, please see our Online Privacy Policy.

     

    • California Minors

     

    Although our online services are intended for an adult audience, any California resident under eighteen (18) years of age who has registered to use our online services and has posted content or information on the services may request removal of the content or information by contacting us here with details of where the content or information was posted and proof that you posted the content or information. We will make reasonable, good-faith efforts to remove the posting from public view or anonymize it so that the minor cannot be personally identified, to the extent required by applicable law. This removal process does not ensure complete or comprehensive removal. For example, third parties may have republished or archived the content through search engines and other agencies that we do not control.

     

    C. Recording and Chat Function Technology

     

    We may collect, monitor and record information you enter into the chat feature of the Service in order to provide you with information and support. The actions you take when using our websites, applications or other services, including some or all of your sessions using our services, information you submit on our services or communications or information sent through or using our services, may be collected, retained and/or monitored by us or our service providers and third-party partners. We may also collect, monitor and record conversations in chat features for the purposes described in this Privacy Policy. In addition, we may collect, monitor and record certain device data (such as browser type, operating system, device identification number and IP address) and usage data (such as date/time stamp). Such information, records and data may be disclosed to, processed and stored by companies and service providers for our business purposes.

     

    By using the Services, you accept and consent to our collection of such data and sharing of that data with our service providers.
    You further acknowledge and agree that by communicating with our customer service team, we may record the conversation for quality assurance and training purposes. These recordings will be made using the Zendesk platform. The data collected will be used to improve our customer service experience and effectively resolve customer issues.

     

    D. Interest-Based Advertising

     

    The Company may employ and work with agents, vendors, consultants, payment processors, tax and compliance vendors and other service providers (collectively, "Service Providers") and other third parties to serve advertisements on the Service and/or Third-Party Services. Some of these advertisements may be tailored to your interests based on your browsing on the Service and other websites on the Internet, which may include cross-device data, sometimes referred to as “interest-based advertising” and “online behavioral advertising” ("Interest-Based Advertising"), which may include sending you advertisements on third-party services after you have left the Service (i.e., “retargeting”).

     

    The following describes the categories of information shared with service providers and the results, purposes, and benefits of doing so if you opt out of interest-based advertising.

     

    Meta

     

    Meta's Privacy Policy

     

    As described in the "How do we use your information?" section of the Meta Privacy Policy, Meta may use information to personalize your experience, including advertising, and for other purposes, such as: promoting safety, security, and integrity; providing measurement, analytics, and business services; communicating with you; and conducting research and innovation for social good. For some purposes, Meta uses information in its products and on your device.


    According to the "How do we share information with third parties?" section of Meta's privacy policy, Meta will not "sell any of your information to anyone," but may share your information with partners, suppliers, service providers, and third parties. Meta requires all such entities to abide by its rules regarding the use and disclosure of information provided by Meta.

     

    The Company may use analytics services provided by Google Analytics, Adobe Analytics or other service providers. These analytics services may use cookies and other tracking technologies to help the Company analyze the users of the Service and how they use it. The information generated by these services (such as your IP address and other usage information) may be transmitted to and stored on these service providers’ servers in the United States (or elsewhere). These service providers may use this information for purposes such as evaluating your use of the Service, compiling statistical reports on Service activity, and providing other services relating to Service activity and other internet usage.

     

    E. eCommerce

     

    Pursuant to California Business and Professions Code Section 17538 et seq., our Online Return and Refund Policy is available here. Our legal name for doing business online is Shenzhen Xiaohaijing Culture Co., Ltd., and our corporate address is Room 1320, Building 10, Lehui Science and Technology Innovation Center, No. 489, Jihua Road, Bantian Community, Bantian Street, Longgang District, Shenzhen. California residents may obtain verification of this information by sending an email to info@bezzze.com within five (5) days of receipt of your request.

    Pursuant to California Civil Code § 1714.43, the Company (a) participates in product supply chain verification to assess and address risks of human trafficking and slavery, which verification is conducted by a third party; (b) conducts independent and occasional audits of suppliers to assess their compliance with the Company’s standards regarding human trafficking and slavery in the supply chain; (c) requires direct suppliers to certify that materials contained in their products comply with the laws of the countries in which they do business regarding slavery and human trafficking; (d) establishes internal accountability standards and procedures for employees or contractors who fail to meet the Company’s standards regarding slavery and human trafficking; and (e) provides training on human trafficking and slavery to employees and management with direct responsibility for supply chain management, particularly with respect to mitigating risks in the product supply chain.
