What is covered by this limited warranty?
Your new Bezzze mattress is covered by the limited Bezzze Lifetime Warranty (the “Warranty”) during the entire period of ownership and use by the original owner (“you,” “your”) .
Insured Persons:
This warranty is valid only to the original purchaser of the mattress, is effective from the date of the original purchase of the mattress, and is not transferable. The "original purchaser" for purposes of this warranty is the first purchaser of the mattress from the Bezzze online store . Please retain a copy of your receipt as proof of purchase and ownership. If the original purchaser sells or otherwise transfers the mattress to another person, this warranty will terminate and the subsequent owner will accept the product "as is" and "with all faults."
Guarantee content:
This warranty applies to mattresses sold and purchased directly from Bezzze or its authorized retailers (“Mattresses”). Bezzze warrants that the Mattress will be free from defects in materials and workmanship (“Defects”) as described below, in its original packaging, from the date of purchase and throughout your ownership and use of the Mattress. A replaced or repaired Mattress will have the same warranty as the original Mattress. For example, if you purchase a replaced or repaired Mattress, the warranty for that Mattress will begin on the date of purchase of the original Mattress. Mattresses must be physically located within the contiguous United States, Alaska, and Hawaii to be eligible for return and/or warranty claims.
The following defects are covered:
– A mattress that has a visible indentation greater than one and a half inches (1.5 inches) due to wear and tear that is not caused by the use of an inappropriate or inadequately supportive bed foundation or frame. Normal wear and tear of a mattress requires the continued support of a matching bed foundation or adjustable bed frame with a suitable frame that is sufficient to support the combined weight of the mattress and all occupants.
– Any physical defect in the mattress that would cause the foam to degrade, split or crack under normal use and proper handling.
– Any manufacturing defects during the assembly of the mattress cover.
This mattress warranty does not cover:
– Any mattress with the mattress cover removed for any reason (removal of the mattress cover will void this warranty);
– Damage to the mattress caused by environmental reasons;
– Any mattress that has been used due to misuse, neglect, accident, or violation of instructions, including but not limited to instructions for placing the mattress on a suitable bed frame;
– The softness of the foam pressure relief material increases normally, but does not affect the pressure relief quality of the mattress;
– comfort preferences;
– Defects caused by physical abuse or damage to the mattress structure and/or covering materials, including but not limited to burns, cuts, tears, liquid damage or stains;
– Mattresses sold as “as is,” “pre-conditioned,” “refurbished,” “used,” “returned,” “previously owned,” or any other similar terminology that indicates the mattress is not “new” or “first-class quality,” or has been previously purchased or used by another consumer, unless otherwise required by applicable law; and,
Bezzze replacement mattress shipped outside the continental U.S., Alaska, and Hawaii .
Warranty Remedies:
In the event of a Defect (as defined above), Bezzze 's sole liability and your exclusive remedy under this Warranty shall be:
– Within the first 10 years of owning your Bezzze mattress, we will replace it with a new Bezzze mattress of equal or greater value, free of charge ;
– Over 10 years, Bezzze will fully repair and repackage your mattress, or replace it, at your option. The only cost to you is a $50 one-way shipping fee, which is waived if Bezzze confirms a defect.
Your responsibilities:
In order for this warranty to be valid, the mattress must be placed on a solid surface, such as a bed frame, that is constructed to support the weight of the mattress and the user throughout use.
You must return your mattress or mattress topper with proof of original purchase. If your mattress or mattress topper is more than 10 years old, you will be responsible for a $50 one-way shipping fee to replace or repair the mattress. This fee will be waived if Bezzze confirms that the mattress is defective in material or workmanship. Bezzze may, at its sole discretion, authorize you to provide photographic evidence of the defect in lieu of returning the mattress.

LIMITATION OF WARRANTIES, DISCLAIMER AND LIMITATION OF LIABILITY:
This warranty gives you specific legal rights, and you may also have other rights which vary from state to state and from jurisdiction to jurisdiction.
TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY AND THE REMEDIES SET FORTH HEREIN ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES, AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS. IF SUCH WARRANTIES CANNOT BE DISCLAIMED, BEZZZ MATTRESS LIMITS THE DURATION OF SUCH WARRANTIES TO THE SHORTER OF: A) THE DURATION OF THIS WRITTEN WARRANTY, OR B) THE MAXIMUM DURATION OF ANY IMPLIED OR STATUTORY WARRANTY PROVIDED BY LAW. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
Bezzze limits the remedy for such warranty to (at Bezzze's option) the repair or replacement service described herein. To the maximum extent permitted by applicable law, except as provided in this Limited Warranty, in no event will Bezzze or its suppliers be liable for procurement of substitute products or other special, incidental, consequential or indirect damages, whether arising out of or in connection with the Bezzze mattress or your or any third party's use of the Bezzze mattress, whether under a theory of contract, tort (including negligence), indemnity, product liability or otherwise. This limitation will apply even if Bezzze has been advised of such damages and notwithstanding the failure of essential purpose of any limited remedy. Bezzze 's total liability shall not exceed the purchase price of the mattress giving rise to such liability. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations and exclusions may not apply to you.
arbitration:
If a dispute arises between you and Bezzze arising out of this warranty, the dispute will be determined and settled by binding arbitration between the parties in accordance with the Commercial Arbitration Rules of the American Arbitration Association (AAA). For more information about the AAA, visit www.adr.org. The arbitration will be held in San Francisco, California. The arbitration will not be joined to any other proceeding or arbitration against either party. Each party will appoint one arbitrator, and the two appointed arbitrators will jointly select the third arbitrator, who will serve as the chairman of the tribunal. If the two arbitrators cannot agree on the third arbitrator, the AAA will appoint the third arbitrator. The AAA may ask you to provide information about the product, including purchase information. Except in special circumstances, the arbitrator will render a decision within 120 days from the date the two appointed arbitrators select the third arbitrator or the date the AAA appoints the third arbitrator. The arbitrator may extend this period by 30 days in the interest of fairness. All arbitration proceedings will be closed to the public and confidential, and all records related thereto will be permanently sealed, except as necessary to obtain court confirmation of the arbitration award. The award and the arbitrator's decision will be in writing and will include a statement of the reasons for disposing of any claim. Any objection to the award shall also be set forth in writing. The arbitrator's award will be final and binding upon the parties, and judgment may be entered in any court having jurisdiction thereof.
Before exercising any rights or seeking any relief under Title I of the Magnuson-Moss Act, you must seek arbitration for any dispute arising out of this Mattress Limited Warranty. The Magnuson-Moss Act does not require arbitration if you choose to seek any rights and remedies not provided by Title I of the Magnuson-Moss Act.
Applicable Law:
This Limited Warranty shall be governed by the laws of the State of California.
